It is very clear that Akechi is dead. But when he does move, it's to stride smoothly to his side, kneeling down to check pulse and breathing. Maybe that was just a bit of stubborn hope - but it's fleeting. He is very certainly dead.
What should he do? What should they do? If the circumstances were different, there probably wouldn't be any question. In the past trials Turo has never been one to consider misvoting, no matter what the circumstances were. He has always vocally supported seeing to the needs of the larger group - it's certainly not good that the culprits be executed, but under the circumstances it's simply the most logical thing to do. You can't let everyone else suffer just because one person decided that their desires were more important, after all. Not when...you actually can stop it.
This, though. He does not raise the alarm for this. He can't - if Arven dies, then what's the point of anything? He can't just let that happen! But he can't - what can he do?]
